However, the ransom note always seemed like a red herring. If John had the presence of mind to give misleading writing samples to the experts, would he not have had the presence of mind to use an altered writing style while writing a note that took approximately 20 minutes just to physically write? Would he risk giving bogus writing samples to experts when it seems reasonable to believe that samples of his writing may be discovered which would implicate him because of his duplicity?<br /><br />I think understanding that this would become a crucial piece of evidence (that would be heavily scrutinized), he would surely have attempted to obfuscate his writing in the note. Like many others here, my interest in this case was just recently renewed due to the sudden release of TV/media releases involving JonBenet’s murder. I was a new mom and working full-time in December 1996 and really had little time to pay much attention to the details. (Of greater “interest” to me at the time was my recognition of the street where the Ramsey’s lived because I attended UC – Boulder in 77-78. I remembered the houses on/in their street/neighborhood were very cool.)<br />The entire “intruder” story always sounded bogus to me. I do remember seeing the interview with Larry King and thought there was no way Patsy should ever have been allowed to do so … she was incoherent at times, she frequently rolled her eyes when she spoke and LOOKED to John to affirm what she had just said. She was so highly drugged, her attorney and even King never should have allowed it. The woman appeared out of her mind. <br />Yes, I buy the JR did it --- not the JR from Dallas. I had the time to follow that “one” far more closely ;) <br />Your theory makes absolute sense to me. The September entries cast even more affirmative SPECULATION on your theory. As you acknowledge and I agree, we will never know what exactly occurred or was spoken or done between JB and JBR in the days leading up to 12/26. I suspect JR did it but do not believe her 12/26 murder occurred as part of a sexual assault. My thoughts:<br />1. I question if the last sexual rape occurred around Thanksgiving (I am basing this only on comments other bloggers have made regarding JBR’s noted clinginess to PR in early December. Not certain if this was based on sworn testimonials or tabloids.) But there was no semen found in or on her body; she was not raped on 12/25 or 12/26. <br />2. I wonder if JBR told her father on Christmas Day that all she REALLY wanted for Christmas was for him to STOP HURTING HER. OR SHE WOULD TELL. I think something happened on Christmas Day that set JR’s mind into frenzied yet exacting action. First things first, he needs to be sure she stays shut up when they are in Charlevoix. <br />3. JR prepared the pineapple dish. (Forget all the fingerprint crap --- sometimes the surface is perfect for prints, other times not.) JR awoke JBR and asked her if she was hungry and wanted a snack/treat. “They have to get up early, she won’t have time to eat breakfast, blah, blah blah…”) She groggily agrees. He takes her down to the kitchen and sets her down in front of pineapple dish. JR starts by manipulating JBR with coaxing her not to say anything. She is stubborn. She is going to tell. (As I recall, she did not digest much pineapple.) JR becomes very angry, out of control and loses it. He sees the flashlight on the counter and hits her on the head. Down she goes.<br />4. And from there we have the ridiculousness of it all…JBR’s hidden body, the broken window, the ransom note, the 911 call; etc., etc…<br /><br />But now I have a question for you, Doc! I have not seen this addressed, admit I have not read your entire blog and apologize if this is repetitive:<br />Why in the world would any parent attempt to schedule a private air trip from Boulder to Atlanta hours after finding his/her six-year-old child’s murdered body in the basement of the family home? It seems incomprehensible to me … other than an aborted attempt to leave the country. Once he's out of the house, and reunites with Burke, he tells him JB is in heaven. Burke is confused, unsure what to think. John tells him (in private) that somebody took JB and hurt her. Meanwhile, John lawyers up and keeps Burke out of the grasp of authorities as much as possible, but tells Burke that it's best he never, ever tells anyone about hitting her earlier because his mom will be upset at him and she's already devastated about somebody taking JB and killing her. <br /><br />She doesn't need to know Burke hurt her too. JB's okay now, she's in heaven and nobody can hurt her anymore. It's just the three of them now and they have to stick together. Burke is sad and cries...but only for a little bit. You can't cry forever and you just have to get on with your life. <br /><br />Two weeks later, DSS interviews Burke. They talk to him awhile and he's not so sad anymore. JB's with jesus so no need to worry for her. He's just antsy and uncomfortable. DSS worker asks him to draw a picture of his family. He's excited about drawing his dad first, then his mom...and oh! Him, too! It's just the three of them now. When asked how he thinks JB was killed, since his father already explained somebody came in and took her from her room, he says somebody came in and quietly took her downstairs and stabbed her and hit her in the head with a hammer. <br /><br />This was chilling to some but generally speaking, they could see Burke being rather oblivious overall and only with slight reluctance concluded he wasn't involved. <br /><br />Meanwhile, John's keeping Patsy overly medicated so she can't put two and two together. The public is now up in arms and the Ramseys set about spin control, doing everything in their power - led by John - to keep Burke as far away from the center of it as possible as details begin emerging. <br /><br />Burke is misled into believing that though he hit her, she was okay after all and later somebody bad came in and took her, then killed her. He's not the worried sort so he accepts that and gets on with it. For most of his life, he's shielded from the "armchair sleuths" ripping into this case so has no details about it all and has moved on with life. He'd be more inclined to believe his parents over the mean police out to get them, or the media clownshow out to harass him. He'd been shielded for over a decade and remained out of the limelight until recently.<br /><br />However, he was instructed to avoid detailing anything as it would only reignite the flames of accusation. Be brief, don't recall, don't detail. And be done with it.<br /><br /><br />That's the flow. Obviously I don't know for absolute fact this is what happened, but it fits with the known evidence and it's a reasonable scenario. The biggest issue is, of course, the garrotting as part of the staging if she was known to be alive at the time. Patsy's...John makes his way back to their room. Patsy's asleep but will be up soon. He slips into the bed so he can be there and 'wake up' when she does. As the alarm sounds and Patsy gets up, John gets up and heads to the bathroom to not face her...he knows how it should play out. She will go downstairs, find the note and get hysterical. They will follow the kidnapper's orders and John will go downstairs and collect JB in a duffel or suitcase and leave with her, on pretense of going to get the ransom money and it can 'derail' from there, resulting in the kidnappers following through on their word.<br /><br />Patsy, still in her gown, goes downstairs - stopping by the laundry room and as she reaches the bottom of the stairs, sees paper on it. She picks it up, half reads it, gets the gist of it and rushes upstairs to JB's room. JB is not there. Patsy gets hysterical and screams for John, who exits the shower and finds her. Patsy runs to Burke's room sobbing "where's my baby!" over and over, waking Burke up.<br /><br />Burke is confused. Unsure what's going on and why his mom is going all psycho. <br /><br />Patsy runs out, back downstairs. John's on the floor with the note spread out. He's reading it to her - and before he gets to the part instructing them to not involve the authorities, Patsy's grabbed the phone and dials 911. John can't get to her in time to stop her and he can't very well argue with her over it so he has to alter the plan a bit. It's a kidnapping so the cops will question them and they can refuse authorities getting involved as per instructions. He'll send them away and leave to make the drop. Instead, he will take JB away from the home and dispose of her body, bury her somewhere.<br /><br />Meanwhile, Patsy's now calling all her friends and pastor...and more people start showing up. A couple of cops show up. Then more show up. John realizes he can't get JB out of the home at this point. He needs to get Burke out of the house when he learns a cop went upstairs and began making a beta search of the home. Burke sees the cops and isn't sure what's going on.<br /><br />John goes into Burke's room and tells him he needs to go to Fleet's. Burke asks what's going on. John tells him JB is missing. Burke is a little confused but infers that JB must have woken up and is okay otherwise. John tells Burke to not say anything at all about earlier or he's in for it. Burke agrees to do as he's told and is taken out of the house to Fleet's.<br /><br />Meanwhile, Patsy's hysterical and John keeps his distance out of shame, guilt, uncertainty and dread. He makes the plan to keep his travel plans and to get them all out of the home so he can return later and handle the problem of JB in the basement. The cop tells John he's not going anywhere and it quickly sinks in that there's no way John will be able to get JB out of there any time soon...and they're searching the house. If they find her first, John's in a world of shit.<br /><br />He makes the decision to break plan for damage control when Arndt tells him and Fleet to go search the place top to bottom...John immediately heads for the basement with Fleet and while Fleet is distracted in the broken window room, John "discovers" JB in the wine cellar. He picks her up under her arms, holding her out in front of him, her stiff arms and head bobbing with rigor as he screams out and rushes upstairs where everyone is. <br /><br />He puts her on the floor. Arndt perceives a curious glint in his expression that raises all her red flags. Patsy rushes in, sees JB on the floor, hurls herself onto her daughter and loses it. Concerned Burke had been inappropriate with her in the past he tells Burke she'll be okay and sends him to bed, demanding he stay there and go to bed.<br /><br />Meanwhile, John is facing the realization JB is dead. He can't revive her. He's concerned about the panties and suspects there's more to it. This information would devastate Patsy and ruin their lives, ruin Burke's life - he recognized Burke's innocent curiosity that's still inappropriate and that can't get out. JB is gone. He sees the resulting implosion of their lives and decides the best way to proceed is to cover it up, for Burke's sake, for Patsy's sake, for their lives' sake. Reputation above all. <br /><br />He's wealthy and kidnapping comes to mind as a way to get her removed from the home. He goes upstairs to look in on Patsy - she's out cold. He stops by JB's room to get something to wrap her in...the blanket, inadvertently grabbing/snagging the nightgown with it. Downstairs, he puts the blanket over JB. He needs it to look like somebody broke in and took her. He uses an object and as quietly as possible breaks the glass on the window and opens it. <br /><br />They need a ransom note. He goes to the butler's kitchen, grabs the notepad and pen, and goes back to the basement, closing doors behind so he can work undisturbed. He begins writing the note, practicing. Messes up. Starts over. Gets a ways into it when he hears JB sputter, gasp, choke. His heart stops and he rushes to her, removes the blanket. She's not conscious, she's not reviving. He sees mucous flooding out of her nose and mouth. She goes quiet. <br /><br />The kidnappers would tie her up and put tape over her mouth. He finds a cord in the craft pile, along with some tape and fashions the cord into the garrote, and binding her wrists, staging the "attempted beheading." They will be leaving and he needs a way to get her out of the house in plain sight. He sees the suitcase and attempts to put her inside it but she's too big. He removes her and puts the suitcase back. He's losing time. She expires in actuality and her bladder lets go on the floor. <br /><br />The plan is to hide her until he can safely get her out of the house. He unlatches the wood block over the wine cellar door, wraps her up and places her inside. He exits, closes the door and turns the wood latch to the locked position. He tears out the note and replaces the pad and pen after wiping it down. He wipes down the flashlight. He surveys the area and places the note on the steps as he makes his way back upstairs. He stops in Burke's room but Burke is now asleep. <br /><br />Burke went to sleep a little easier since his dad told him JB would be okay and not to worry. And he promised he wouldn't tell Burke's mom. So neither would Burke. While I still lean toward Patsy...Burke Theory Pt 1<br /><br />While I still lean toward Patsy writing the ransom note, Doc made enough of a good case for John doing it that I will give Patsy benefit of doubt in this scenario. I never had much of a theory overall other than pretty settled Patsy wrote the note and something happened they covered up. After years not delving, when I resumed it recently, my curiosity about why Burke was suspected was piqued so I looked into it, then watched these interviews and read Kolar's book, but it was Burke's own statements that strengthened my suspicion Burke was involved. <br /><br />Without trying to twist and come up with nonsensical scenarios, the one that flowed was actually reasonable in a loving, mostly healthy sort of family but with some issues that they'd deal with behind closed doors.<br /><br />They return from the party. JB is put to bed. Burke and John go to the basement awhile to tinker with Burke's model - John's letting him indulge a bit since they'd had a busy day and he'd not had a lot of time to play with his new stuff. Then he needed to get Burke up to bed so they could get up early for their trip. He told a reluctant Burke to wrap it up and it's time for bed. Burke huffed and went into the kitchen. Recently, the stairwell light had burned out and they'd not had a chance to replace it so John grabbed a flashlight and took Burke to bed.<br /><br />Meanwhile, Patsy changed for bed and after reading JB a story, she went on to sleep. An hour later, she's out cold. John puts Burke to bed and sets the flashlight out in the laundry room area counter. <br /><br />Awhile later, when it's quiet, Burke decides he's not done with the model. As he exits his room, he sees JB and she tells him she had an accident and went potty in the bed. Burke doesn't want her to get in trouble so he tells her to come with him downstairs and he'll help clean her up. He grabs the flashlight and they sneak quietly downstairs.<br /><br />Down in the kitchen, they "maybe" have some pineapple and then down to the basement. Burke clumsily tries to help her change out of her wet clothing and while she's naked at the waist, his prepubescent curiosity is triggered. Being 9, though, he'd reasonably be a blend of curious and repulsed (i.e. girls are gross, sex grown up stuff is gross, kissing is gross, etc), so instead of his own body parts, he uses a stand in - the paint stick and engages messing with her. JB may or may not have indulged, but at some point of insertion the stick scrapes her, hurts her and draws blood.<br /><br />Upon the pain, JB halts it and says she's going to tell. Burke tries to convince her not to but she's crying because it hurt - brother hurt her - and she's going to tell. Burke, in a moment of fear and panic, hits her with the flashlight to stop her. JB falls to the floor outside the train room, unconscious. He first thinks she's pretending but when she doesn't revive, he - being the non plussed sort of non worrier who dislikes conflict - leaves her on the floor and resumes messing with the model figuring she'll wake up. <br /><br />After awhile, she doesn't and he checks on her. He inserts the stick again but she doesn't stir. Now he realizes he's in trouble, he's scared because she won't wake up. He grabs some panties and puts them on her, not realizing or concerning with the fact they're huge on her. <br /><br />He goes upstairs and slips into his parents room and wakes his dad. John rouses and Burke tells him to come downstairs, something happened, don't wake up mom. John's groggy but follows Burke to the basement and sees JB out cold on the floor. Burke's concerned but not in tears because he doesn't quite grasp the scope of what's happened. Smit is on video with the open window saying somebody "could have" come through it, and he experimented and when he saw he could do it, he empirically decided that's what happened. He saw a smudge on the wall and said it "could have" been from a shoe sole sliding against the wall in or out, therefore that's what it was. He said it "could have" been the suitcase used to stand on or to try to get her out but then couldn't get out with the suitcase so unpacked her and left her in the wine cellar...and since the intruder could have done this, therefore that's what happened. He's on video saying this stuff and then sweepingly deciding this is what happened. If this is how he gained convictions previously every case he worked on should be re examined.<br /><br />Smit ignored a ton of information, such as the cobwebs and bedwetting and Burke and interviews and lies, and he saw marks on her neck that reminded him of a stun gun use case and said it could have been one, therefore that's what it was, therefore, the Ramseys are innocent. <br /><br />Smit is discredited across the board in my book for these reasons. <br /><br />That leaves "inside the house" and my theory, newly formed (or forming) follows. What you call "mental gymnastics" are my attempts to deal with aspects that are difficult to understand, regardless of what one's theory might be or who did the crime. Most if not all other theories of the case simply ignore certain contradictions or puzzles that require digging more deeply into certain matters, such as the psychology of the main actors. Because I refuse to ignore them I am forced to consider certain possibilities that might seem contrived or convoluted, yes. And if anyone can come up with a more straightforward explanation that would be great. That's one reason I started this blog, to open my analysis up to criticism and see if anyone else had a better idea. <br /><br />For me the key to the case lies not in my attempts to explain certain details that might not seem to fit, which are frankly speculative, but the facts and logic of the case as outlined in my first two posts. If my logic is correct, and I believe it is, then we already know who did this crime. And everything else must be understood in the light of that realization.
